Terms of Service & Data Processing

These terms govern your use of kwebbel (the “Service”). By installing or using the app you (“Merchant”) agree to them. Our handling of personal data is described in our Privacy Policy, which forms part of these terms.

1. The Service

kwebbel provides an AI sales and support agent that runs on your Shopify storefront and a dashboard to configure it. We provide the Service on an “as is” basis and aim for high availability but do not guarantee uninterrupted operation. AI-generated responses can occasionally be inaccurate; you are responsible for the content, offers, and policies you configure the agent to use.

2. Your responsibilities

• Keep your account credentials secure and configure the agent’s content, offers, and boundaries accurately.
• Ensure you have the right to provide the store and customer data the Service processes.
• Maintain your own privacy notice to your shoppers as required by law.

3. Billing

Paid plans are billed via Stripe on the cycle you select, after any free trial. Usage beyond a plan’s included volume may incur overage per the plan you chose. You can cancel anytime; access continues until the end of the paid period.

4. Data Processing Addendum

For personal data of your customers and site visitors, kwebbel acts as a data processor and you act as the data controller. We agree that we:

• process personal data only to provide the Service, on your documented instructions;
• process only the minimum data required (see the Privacy Policy), and never sell it or use it for advertising;
• keep personal data confidential and apply appropriate technical and organizational security measures (encryption in transit and at rest, access controls, logging, and rate limiting);
• use only the sub-processors listed in the Privacy Policy, each bound to equivalent obligations;
• assist you with data-subject requests and delete data on a Shopify redact/uninstall event as described in the Privacy Policy;
• notify you without undue delay if we become aware of a personal-data breach affecting your data.

5. Termination

You may stop using the Service and uninstall at any time. On uninstall, your store’s data is deleted within 48 hours (via Shopify’s shop/redact webhook). We may suspend the Service for abuse or non-payment.

6. Liability

To the extent permitted by law, kwebbel is not liable for indirect or consequential damages, and our total liability is limited to the fees you paid in the three months before the claim.
